Legal Representation

We provide representation by an attorney in all discipline matters, from the administrative investigation through any administrative appeal, including matters involving suspension, demotion or dismissal. Our attorneys also are available to consult with shop stewards and executive board members who are representing members in informal proceedings.

Our labor attorneys are available 24/7 to respond to critical incidents, e.g., officer-involved shootings, deaths in custody, or any event causing injury or death to a suspect. The firm has a 24-hour toll-free telephone line to allow our clients and association representatives to reach an attorney within minutes after a critical incident.

We provide attorney representation to our client associations in drafting by-laws, constitutions, and articles of incorporation, as well as assistance in obtaining state and federal tax-exempt status. Our attorneys also assist the associations in various matters affecting the governance of the association, such as obtaining services from vendors, establishing a political action committee, and providing corporate counsel at meetings of the Executive Board and general membership.

The Labor Department has a team of attorneys who represent public and private sector clients in Fair Labor Standards Act (FLSA) litigation throughout California. Our labor attorneys also represent employees in state wage and hour claims, contract disputes, disability retirement appeals, and other employment disputes, and provide litigation support to our contract negotiators.

Contract Negotiations

Mastagni, Holstedt, Amick, Miller, Johnsen & Uhrhammer has a team of experienced law enforcement labor negotiators who provide collective bargaining services, representation at "meet and confer" sessions, and assistance with contract grievances. Our negotiators have over 150 years of combined experience in contract negotiation and enforcement, labor association operations, and police practices.

With proven knowledge and experience, our labor negotiators consistently achieve significant wage and benefit improvements for our client associations. Our negotiators are recognized statewide as experts in the 3%@50 enhanced retirement benefit, binding arbitration, and health care benefits. We have one of the highest 3%@50 success rates in the state and have been instrumental in implementing union-sponsored health care savings plans and other mechanisms for reducing health care costs for represented employees.
